Welcome to the Lumen Customer Community (the “Community”). By joining the Community, You, the customer (“You,” “Your”) agree to these terms and conditions of use, which constitute a contract between You and Lumen Technologies, Inc. (“Us”, “We”, “Lumen”), headquartered at 100 CenturyLink Drive, Monroe, LA, 71203.
1.1. The Community is a web-based platform allowing You and other Lumen Customer Community participants (“Advocates”) to engage in challenges to promote Lumen, or which allow You to share Your Lumen experiences. Examples of these challenges include, for example, sharing on social media, speaking at an event, and talking about Us to others (each, a “Challenge”).
1.2. You agree that by providing Us with Your information and clicking “Accept”, You enter into a legally binding agreement with Us.
1.3. The terms and conditions set out in this document are the “User Agreement”. Your “Agreement” with Us includes this User Agreement, our Privacy Policy and any other terms displayed when features or services are accessed or used, all as may be amended from time to time in Lumen’s sole discretion. Amendments are effective immediately when made and Your continued use and participation in the Community following such changes constitutes acceptance and agreement to such changes. By interacting with the Community, You agree to the terms of the Agreement.
2.1. Your participation in the Community is completely voluntary. You may cancel Your account at any time. Participation in Challenges is also voluntary. You are free to refuse to participate in any Challenge.
2.2. The Community allows You to interact with Us and other Advocates by posting Your own content to the Community. “Content” means anything You post to the Community, including opinions, expressions, points of view, articles, videos, messages, photos, advice or any other information.
2.3. As between You and Us, You own the Content that You post to the Community. However, by posting Content, You grant Us (including our affiliates, agents, subcontractors and service providers, and each of their and our respective licensees, successors, and assigns) the irrevocable, worldwide, royalty-free, unlimited and perpetual right and permission to use, edit, perform, display, reproduce, create derivative works of, publish, use, disclose, disseminate and otherwise distribute to third parties any such Content for any purpose and in any manner, including without limitation via the Community, public media, marketing documentation, broadcast television, the Internet and Lumen’s intranet, solicitations to Lumen’s customers and any other form of advertising, and including without limitation, in association with Your name and likeness, biographical data (including job title, job location and employer’s name) and statements or quotations attributable to me and/or my likeness (“my Characteristics”). I hereby disclaim any and all claims that I would otherwise have against Lumen related to the Content and my Characteristics whether arising under any statutory or common law, including without limitation, any claims concerning rights of privacy, moral rights, rights of publicity and/or likeness or any other applicable law. I agree to release, indemnify and hold harmless Lumen from and against any claims for injury, loss or damage of any kind, including but not limited to copyright infringement or infringement or violation of my rights of publicity or privacy, resulting from Lumen’s use, editing, reproduction, distribution, publication, performance, display or preparation of derivative works of my Content and my Characteristics. I understand that Lumen is not responsible for the actions of third parties with respect to my Content and my Characteristics. I hereby waive any right to royalties or other compensation arising or related to the use of my Content and my Characteristics in connection herewith.
2.4 I represent and warrant that all the Content will be original and that the Content will not infringe upon, violate or misappropriate any copyrights or other intellectual property rights of any third party, nor will the Content infringe upon, violate or misappropriate any third party privacy or publicity rights, nor will the Content violate any applicable laws, rules or regulations, nor will the Content include any minor under the age of 18 years old (collectively, “Representations and Warranties”). I hereby agree to defend, indemnify and hold Lumen harmless from and against any damages, losses, expenses (including attorneys’ fees) and liability associated with a breach of any of the foregoing Representations and Warranties.
2.5. We may award You points based on successful completion of Challenges. We will automatically track Your points for You. We will also display a leaderboard within the Community that sets out the number of points each Advocate has been awarded. This leaderboard is viewable by all other Advocates of the Community. Please note that You can remove yourself from the leaderboard at any point in time, in Your sole discretion.
2.6. We appreciate Your thoughts about the Community. By submitting Feedback about the Community to Us, You hereby grant to Lumen and its affiliates, agents and subcontractors a perpetual, worldwide, non-exclusive, and fully transferrable license to use, profit from, disclose, publish, share, keep secret, exploit or create derivative works which incorporate, in whole or in part, the Feedback without compensation to You.
2.7. By participating in the Community, You certify that You will do so consistent with applicable laws, and any rule, policy, requirement or Code of Conduct of Your own organization, where applicable, including any policies addressing confidentiality, antitrust and fair competition, conflicts of interest, and the acceptance of gifts and gratuities.
